Acceptance of Terms

The services that Fly Currents LLC provides to you are subject to the following Terms and Conditions (“T&C”). Fly Currents LLC reserves the right to update the T&C at any time without notice to you. The most current version of the T&C can be reviewed by clicking on the “Terms and Conditions” hypertext link located at the bottom of our Web pages.

Description of Services

Through this Web Site, Fly Currents LLC provides you with current and comprehensive fly fishing reports from various locations. Information provided is the best available knowledge of the report writer at the time of submission. Any forecasts of future conditions are speculations based on weather and previous events.

Personal and Non-commercial Use Limitation

Unless otherwise specified, the Services are for your personal and non-commercial use. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, products, or services obtained from the Services.

Notice of Documents and Services Available on this Web Site

In no event shall Fly Currents LLC and/or its respective suppliers be liable for any special, indirect or consequential damages or any damages whatsoever resulting from the loss of use, data or profits, whether in an action of contract, negligence or other tortuous action, arising out of or in connection with the use or performance of software, documents, provisions of or failure to provide services, or information available from the services.

Member Account, Password, and Security

To access the Services you must open an account, you must complete the registration process by providing us with current, complete and accurate information as prompted by the applicable registration form. You also will choose a password and a user name. You are entirely responsible for maintaining the confidentiality of your password and account. You agree to notify Fly Currents LLC immediately of any unauthorized use of your account or any other breach of security. Fly Currents LLC will not be liable for any loss you may incur as a result of someone else using your password or account, either with or without your knowledge. However, you could be held liable for losses incurred by Fly Currents LLC or another party due to someone else using your account or password. You may not use anyone else’s account at any time.

No Unlawful or Prohibited Use

As a condition of your use of the Services, you will not use the Services for any purpose that is unlawful or prohibited by these terms, conditions and notices. You may not use the Services in any manner that could damage, disable, overburden, or impair any Fly Currents LLC server, or the networks connected to any Fly Currents LLC server, or interfere with any other party’s use and enjoyment of any Services. You may not attempt to gain unauthorized access to any Services, other accounts, computer systems or networks connected to Fly Currents LLC server or to any of the Services, through hacking, password mining, or other means.

Intellectual Property

You acknowledge and agree that (a) all Content is the copyrighted work of Fly Currents LLC and is protected by copyright laws, (b) the “Fly Currents LLC” name , the domain www.flycurrents.com, the Fly Currents logo, all page headers, custom graphics and button icons are service marks, trademarks and/or trade dress of Fly Currents LLC (collectively “Marks”). In addition, to comply with all applicable laws, you agree you will not use any such Content or Marks from the Web Site for any purpose without the appropriate prior written authorization.

The linked sites are not under the control of Fly Currents and Fly Currents is not responsible for the contents of any linked site or any link contained in a linked site, or any changes or updates to such sites. Fly Currents is providing these links to you only as a convenience, and the inclusion of any link does not imply endorsement by Fly Currents of the site.

Membership Fees and Billing

Your membership in the Services is effective for the period covered by your membership fee and continues upon your payment of the renewal fee. Renewal fees for your membership will automatically be charged, at the then current rate, to the credit card or other billing source authorized by you until you cancel your membership. You may cancel your membership and terminate further billing by sending an e-mail to the Customer Service Department with the cancellation request to: info@flycurrents.com. If you have chosen the quarterly membership term and you cancel within the first 30 days of when you were billed, you will receive one half of the quarterly membership fee. Any cancellations after the 30th day will not be eligible for a refund. If you are a member using the quarterly term free trial offer and you choose to cancel after your trial membership has expired and a transaction has been processed, your membership will end immediately and you will be eligible for a refund of one half of the quarterly fee. If you are a member using the monthly term free trial offer and you choose to cancel after your trial membership has expired and a transaction has been processed you will not be eligible for a refund.

Membership with Free Trial

The free trial is a special offer limited to first-time customers only. Returning members are not eligible for the free trial period unless pre-authorized by Fly Currents LLC and will be billed the membership fee immediately upon renewal. During your trial period, you are bound by the same T&C as paying members. You will be asked for valid credit card information when you sign up for the fly fishing information service. Fly Currents LLC will verify your credit card information before processing your order and an authorization will be performed on your credit card to verify the card is valid and in good standing. This transaction will be held in a pending status until the free trial period has passed. The three month membership term provides a first-time customer a fourteen day trial period. The one month membership term provides a first-time customer a three day trial period. If you do not cancel during your trial period, your membership will continue automatically and the monthly or quarterly fee will be billed to the credit card or other billing source authorized by you.

Membership without Free Trial

The monthly or quarterly fee for the Fly Currents membership term length for which you have chosen without a trial period will be billed immediately to the credit card or other billing source authorized by you.
